1. Acceptance of Terms

By accessing or using the XTRY platform ("Service"), including our website at xtry.pro and our mobile applications, you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. What XTRY Is

XTRY is a marketplace platform that connects athletes with martial arts gyms, trainers, and venue operators. XTRY provides discovery, booking, and payment tools so you can find and reserve training sessions and packages. XTRY does not own, operate, or control the gyms listed on the platform, and is not responsible for the training services those independent businesses deliver.

3. Independent Gyms

Gyms, trainers, and venue operators listed on XTRY are independent third-party businesses. They are not employees, agents, partners, or franchisees of XTRY. Each provider is solely responsible for the services it offers, including class quality, scheduling, safety, and compliance with local laws.

Each provider is also responsible for its own income, business, and other taxes on the amounts it receives, and for any permits or licenses required to operate. XTRY does not guarantee the accuracy, completeness, or current status of any listing.

4. Payments & Taxes

Payments for bookings are processed through XTRY using our payment provider, Stripe. XTRY facilitates the payment between you and the independent gym; being able to pay through XTRY does not make XTRY the provider of the training itself, and the gym remains solely responsible for delivering the session you booked.

Any taxes that apply to your booking are calculated and shown at checkout and handled in accordance with applicable law.

5. Events & Third-Party Tickets

Some events listed on XTRY are provided for information and discovery only. Tickets for these events are sold by the event organizer or a third-party ticketing provider on their own website, not through XTRY. When you follow a link to buy tickets, you leave XTRY and complete the purchase with that provider under its own terms.

Payment, admission, changes, and refunds for these events are handled entirely by the organizer or ticketing provider. XTRY is not the seller, does not process these payments, and is not responsible for these transactions or the events themselves.

6. Bookings, Cancellations & Refunds

A confirmed booking is a reservation for a specific session or package with an independent gym. Availability, scheduling, and attendance requirements are set by the gym. Where a refund is due, it is issued through XTRY to your original payment method. Refund eligibility depends on the gym's cancellation policy and applicable law.

7. User Conduct

When using XTRY, you agree not to:

• Submit false, misleading, or fraudulent information in any form, inquiry, or booking.
• Attempt to gain unauthorized access to any part of the platform or its data.
• Use automated tools to scrape, crawl, or harvest data without our written consent.
• Impersonate any gym, organization, or individual.
• Transmit any content that is unlawful, harmful, or infringes third-party rights.

8. Intellectual Property

All content on the XTRY platform — including logos, text, graphics, and software — is owned by or licensed to XTRY. You may not reproduce, distribute, or create derivative works without our prior written permission.

By submitting photos, logos, or other content to XTRY (e.g., via a partnership inquiry or gym listing), you grant XTRY a non-exclusive, royalty-free license to display that content on the platform.

9. Disclaimer of Warranties

The Service is provided "as is" without warranty of any kind, express or implied. XTRY does not warrant that the Service will be uninterrupted, error-free, or free of viruses, nor does it warrant the training services provided by independent gyms. Use of the Service is at your own risk.

10. Limitation of Liability

To the fullest extent permitted by law, XTRY shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of data, loss of revenue, or personal injury arising from training with an independent gym.

11. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through good-faith negotiation before formal proceedings.

12. Changes to Terms

We may update these Terms at any time. We will notify users of material changes by posting the new Terms on this page with an updated date. Continued use of the Service after changes constitutes acceptance.
